In New York, both claimants and insurance companies have specific rights and obligations regarding the recording of Independent Medical Examinations (IMEs).

Claimant’s Rights:

  • Right to Record the Examination: Claimants are entitled to videotape or otherwise record their IME. They must be informed of this right at least seven business days before the examination. New York Public Law

Insurance Company’s Obligations:

  • Notification Requirements: If the practitioner intends to record the examination, the claimant must be notified by mail at least seven business days prior. This notice should also inform the claimant of their right to record the examination. New York Public Law
  • Conducting the Examination: IMEs should be performed during regular business hours unless the claimant consents to a different time. The location must be convenient and accessible, within a reasonable distance from the claimant’s residence. New York Public Law
